Monteith’s Beer Back Guarantee
Conditions of Participation
The promoter of the Monteith's Beer Back Guarantee is DB Breweries Limited, 1 Bairds Rd, Otahuhu 2025, New Zealand ("Promoter").
The Monteith's Beer Back Guarantee ("Promotion") is open to anyone 18 years of age or over.
The Promotion starts on the 19th July 2017 and will continue while stocks last or until the 30th of September 2017 (whichever is the earlier) ("Promotional Period").
Information on participation forms part of these terms and conditions. Participation in the Promotion is deemed to be acceptance of these terms and conditions by the participant.

To participate
Buy any specially marked 6 pack of Monteith’s XPA, or any specially marked 6 or 12 pack of Monteith’s The Barber Lager product during the Promotion Period. Try the first bottle from the pack and, if you don’t like it, you can claim a replacement Monteith’s product by:
Going to the Monteith’s website (Monteiths.co.nz);
Uploading a photo of your proof of purchase; and
Filling in the claim form. Each claim must include your full name (which is identical to your valid ID documentation), mobile phone number and email address for validation purposes.
You must correctly fill in the claim form located on the Monteith’s website during the Promotional Period. No claims will be accepted outside the Promotional Period. Any claim forms that are not filled in correctly will be deemed invalid.
In relation to redemption:
One proof of purchase will give a participant one redemption opportunity. The proof of purchase is only valid once.
There is a limit of one redemption per person for each of the two Monteith’s products relevant to this Promotion (being Monteith’s XPA and Monteith’s The Barber Lager) during the Promotional Period.
The Promoter reserves the right to request a participant to return the unconsumed beers from the original pack to the Promoter at the participant’s cost.
Once a claim has been validated, the Promoter will send the participant a voucher for a replacement Monteith’s product via email, which is redeemable at all major retailers.
Participants will be required to present a valid ID, matching the name printed on the voucher, in order to redeem the voucher.
Vouchers must be redeemed within 2 weeks of the date of the relevant email from the Promoter attaching the voucher.
Claims are deemed to be received at the time of receipt into the Promoter’s database and not at the time of transmission by the participant. The Promoter is not responsible for incorrect, inaccurate or incomplete information provided by a participant or occurring during transmission or delivery. The Promoter is not responsible for any problems or technical malfunction of any telephone, telephone or computer network, or lines, servers, or telephone or internet providers, traffic congestion on any telephone or computer network, or any combination thereof, including any injury or damage to participants or any other person's handset or computer related to or resulting from participation or sending or receiving of any communication or of any materials in this Promotion.
The Promoter reserves the right to verify the validity of claims and to disqualify any participant who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the claim or redemption process or engaged in any unlawful or other improper misconduct which jeopardises the fair and proper conduct of the Promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.

GENERAL TERMS AND CONDITIONS
The Promoter’s decision on any aspect of the Promotion is final and binding. The Promoter will not enter into any correspondence in respect of the Promotion.
The Promoter reserves the right at any time to suspend or modify the Promotion, or these Terms and Conditions, without notice and for any reason whatsoever at its sole discretion
These Terms and Conditions are subject to all applicable laws, codes and regulations, including but not limited to the Sale and Supply of Alcohol Act 2012 and the Code for Advertising and Promotion of Alcohol.
The Promoter adheres to all applicable privacy laws and regulations. Participants in the Promotion agree that the Promoter (and its agents and contractors) may collect and retain their personal information in order to conduct the Promotion and for future promotions carried out by the Promoter and its associated companies, unless a participant indicates upon registering that they do not wish to receive any future communications. Participants have the right to request access to their personal information held by or on behalf of the Promoter, and to update or to remove any such information. All such requests should be directed to the Promoter in writing at the address set out above.
Except for any liability that cannot be excluded by law, the Promoter will not be liable for any damage whatsoever incurred by any participant (including but not limited to any indirect or consequential loss. Participants indemnify the Promoter against any liability for accident or loss of life, personal injury, property damage or other loss, cost or expense arising in connection with the Promotion.
