Apple Watch CGA Advice/Help - out of Warranty

Hi team

need some advice/opinion/help on this

Purchased an apple watch SE exactly 3 years back today and the screen of the watch randomly popped out. Took it to the service centre and they said they cant repair watches and it would cost $470 to replace the entire thing. Can I claim CGA on it? Couldn't find anywhere what CGA says for life of smart watches.

Any help/advice appreciated

  • At 3 years, I'd imagine that you might be pushing it.

Is the battery inflated at all?

    • No, the battery looks fine

I understand your situation but I'm no legal expert so maybe you can also pop your questions here: https://www.reddit.com/r/LegalAdviceNZ/

    • Will do thanks

  • Apple is pretty good on these kind of things. Have you contacted them yet?

    • yes, they said its out of warranty so they cant do anything

      • Ah sorry. You said the service centre but I thought you may not have contacted apple directly, as apple doesn’t have a store here.

The difficulty is proving this wasn't user cause damage and is a manufacturer defect. Are there any known cases online where the watch screen de-laminating is a common occurrence? In US, pretty much every generation of apple products are under some sort of class action lawsuit because known defects aren't fixed for several generations, so I would do a little research to see if other users have encountered your problem.

If you have content insurance, it would be a lot easier through that pathway.

  • If you're persistent with apple on the phone you can wear them down - especially if they're overseas and less familiar with the CGA, ie, get them to prove it Shouldn't be covered.

A few years back I'd replaced the battery on an out-of-warrant iPhone with a cheap aliexpress one, and it was expanding - they organised a free repair.
I was very clear with them that it wasn't the original battery.

    • If you go reddit some people from Singapore/Aussie usually represent in the DT so likely have a legal team who know they will loose and tell them to pay up

Call them explain your issue, if they still refuse after a bit just file with DT and wait for them to cave just before the hearing.

Apple watch are a Premium device. And NOT cheap. I'd say that at 3 years old there is NO way that the screen should 'pop off'.

Who did you buy the watch from originally ? And did you ask that particular retailer for a resolution first up ?

If they don't want to repair or replace the watch then you can demand a refund as it's a 'Serious defect' and not one that should be expected at ANY part of it's lifetime. Failing any satisfaction I'd just file a DT case against them and then you can bet either you'll win or they'll just cave in anyway.

****Perhaps if you can't access the original retailer physically then you could go to HN's as they state HN's offer Apple Support in store go there and if they refuse you satisfaction tell them you'll be going to the DT. State that you are not happy with the refusal and ask to speak to a higher up manager. IF they still refuse advise that you WILL be filing a DT claim against them……
